Applications for Sanitary Permits are filed with the Ministry of Health, which is in charge of regulating the activities of manufacture, importation, exportation, storage (whether or not of commercial nature), distribution and sale of pharmaceutical, cosmetic, natural, veterinary and medical products in order to determine, through the analysis and study for evaluating the efficacy, security and quality of said products, whether they are suitable for human, animal and plant consumption. Every natural person or legal entity engaged in the above mentioned activities is obliged to maintain and improve the conditions for the manufacture, marketing and storage of said products in order to ensure their consumption; failure to comply with this obligation is penalized.
If the sanitary authorities determine that the products submitted for analysis are detrimental to health, they shall not grant the Sanitary Permit.
The promotion of products within the country is limited to those approved and registered therein, which promotion must be consistent with the national sanitary policy and comply with the national regulations. As promotion is understood all the series of information, publicity, advertising, and persuasion activities deployed by manufacturers and distributors through the media with the purpose of inducing the prescription, purchase, consumption or use of the products being promoted. Needless to say, ethical and sanitary criteria contributing to the rational use of the product must be abode by.
